BRITISHSHOP.PL TERMS AND CONDITIONS

  1. DEFINITIONS

Seller – Fish and Chips Spółka z o.o. – the owner of the website britishshop.pl, headquartered in Warsaw at ul. Stefana Batorego 18/108, 02-591, registered in the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under KRS number 0000330033, NIP: 5252455317, REGON: 141883310, BDO number: 000556105, share capital: 5,000.00 PLN. Contact details: e-mail address: [email protected], phone: 883744933.

Website britishshop.pl – an internet platform available at www.britishshop.pl, enabling browsing of the product offer and making purchases.

britishshop.pl – the online store operated by the Seller, where purchases can be made through the britishshop.pl website.

Terms and Conditions – this document defining the terms and rules of making purchases at britishshop.pl, in accordance with the Consumer Rights Act and other applicable laws.

Website Regulations – a document defining the rules for using the britishshop.pl website, including the use of store functionalities, privacy policy, cookies, and data security.

Account – an individual Client profile in the britishshop.pl IT system, identified by a login and password, allowing for placing orders, viewing order history, and using store services.

Client – any natural or legal person making purchases at britishshop.pl.

Consumer – a natural person purchasing goods from the Seller for purposes not directly related to their business or professional activity, within the meaning of the Consumer Rights Act.

Entrepreneur with Consumer Rights – a natural person purchasing goods from the Seller under a sales agreement related to their business activity, to the extent that the protections provided to Consumers under the Consumer Rights Act apply.

Minimum age for making purchases at britishshop.pl – 18 years (in the case of alcoholic or other legally regulated products).

Client obligations – the Client is obliged to provide truthful information, safeguard their login and password, update contact details, and use the Account in accordance with the Terms and Conditions.

  1. PURCHASES AT BRITISHSHOP.PL

2.1 Activity
britishshop.pl conducts the sale of goods via the Internet.
Orders can only be placed through the britishshop.pl website.

2.2 Scope of Operation
Services offered by britishshop.pl are available within the territory of the Republic of Poland and selected European Union countries.
The possibility of fulfilling an order is determined based on the declared delivery location and the availability of products imported from the United Kingdom.
Alcoholic products offered in the store contain up to 0.5% alcohol and may be legally sold in Poland as non-alcoholic beverages; Clients purchasing to the EU are responsible for compliance with the regulations of the destination country.
Shipment of alcohol above 0.5% is not offered and will not be fulfilled.

2.3 Buyers
Only natural persons with full legal capacity, as well as legal entities and organizational units with legal capacity, may use the britishshop.pl offer.
Registration of a Client account on britishshop.pl is free of charge. By registering, a Client enters into an agreement for the provision of electronic services consisting of managing the Account, in accordance with the Website Regulations. The Account allows placing orders, tracking order history, and submitting complaints.
The Client may delete their Account at any time by informing the Seller ([email protected]). Upon deletion, all data will be removed, except for data necessary for handling complaints and claims, which will be retained until the expiration of claims.

2.4 Product Information

2.4.1 Manufacturer Information
Information about products offered for sale on britishshop.pl, such as description, composition, caloric value, package weight, expiration dates, etc., comes from the product manufacturers and may be subject to change.
britishshop.pl makes efforts to ensure that this information is accurate and up-to-date, however, the Client is obliged to review the information provided by the manufacturer on the packaging before use.
Product and packaging photos reflect the product at the time it was added to the offer, but the manufacturer may change the packaging or marketing description.
All alcoholic products offered in the store contain a maximum of 0.5% alcohol. Tobacco products and alcoholic beverages above 0.5% are not sold.

2.4.2 Short-Dated Products
Products with a short "best before" date are clearly marked on the product page. By purchasing such a product, the Client accepts the expiration date indicated in the product description.

2.4.3 Imported Products
Products offered in the britishshop.pl store are imported from the United Kingdom. Product composition, nutritional values, and other information provided in the product description are for informational purposes and come from data provided by the manufacturer or distributor.

2.4.4 Product and Packaging Information
Products offered by Britishshop.pl may be delivered in different packaging variants (e.g., glass or plastic packaging, including "squeezy" types), depending on current availability from the manufacturer or distributor.
Product images presented in the store are for illustrative purposes and may differ from the actual appearance of the product, particularly in terms of:

  • type of packaging
  • label graphics
  • manufacturer markings
    These changes do not affect the properties or quality of the product and, in themselves, do not constitute a basis for a complaint, provided the product complies with the contract.

2.5 Personal Pickup of Orders
The Seller does not offer the option of personal pickup of orders.
Orders are fulfilled exclusively via shipment according to the delivery options available during the ordering process.

2.6 Product Prices

2.6.1 Prices of goods displayed on the britishshop.pl website are gross prices (including VAT) and expressed in Polish zlotys (PLN).

2.6.2 Product prices do not include delivery costs. Delivery costs are indicated to the Client during the ordering process.

2.7 Discounts, Promotions, and Vouchers

2.7.1 Discounts resulting from vouchers issued by britishshop.pl cannot be combined with other promotions or discount programs unless the promotion regulations state otherwise.
2.7.2 Special discounts cannot be combined with other promotions or discount programs unless the conditions of a specific promotion state otherwise.
2.7.3 Due to differences in calculating discounts between net and gross prices, the value of the realized discount may differ from the nominal value by a maximum of 0.3%.
2.7.4 britishshop.pl reserves the right to introduce loyalty programs or other programs providing additional benefits to Clients. Participation rules in such programs will be specified in separate regulations.
2.7.5 For Clients who have given appropriate marketing consent, britishshop.pl may offer promotions and special offers.
2.7.6 In the event of a price reduction announcement, the Seller, along with the information about the reduced price, will also provide information about the lowest price of the product in the 30 days preceding the reduction.

2.8 Order
An order means a Client's declaration of intent to conclude a sales agreement with the Seller, submitted using the mechanisms of the britishshop.pl online store, after selecting the products and specifying the delivery and payment method.

2.9 Sales Agreement

2.9.1 Sales agreements are concluded within an organized system of distance contracts using the mechanisms of the britishshop.pl online store.
2.9.2 After placing an order, the Client receives a confirmation of receipt at the e-mail address provided during the ordering process, including the order number.
2.9.3 The sales agreement is concluded upon sending the Client a confirmation of acceptance of the order for fulfilment by the Seller.

2.10 Delivery, Delivery Costs, and Packaging

2.10.1 The delivery cost, including packaging, is indicated each time during the ordering process.
2.10.2 Depending on the delivery location, product type, and order size, delivery may be carried out via a courier company or parcel locker operator (InPost locker / Pickup Point), selected by the Client during the ordering process.
2.10.3 In the case of choosing delivery to a Parcel Locker / Pickup Point, the delivery address is the address of the Parcel Locker / Pickup Point selected by the Client.
2.10.4 Information about available delivery methods and costs is visible in the shopping cart after adding products.
2.10.5 The Seller reserves the right to introduce quantity limitations on certain products or condition their availability on the order value.
2.10.6 In exceptional cases, where due to technical reasons the store system accepts an order without automatic calculation of delivery costs, the Seller will contact the Client to inform them of individually determined delivery costs. In such a case, the order is not considered accepted for fulfilment until the Client accepts the total order cost, including the product price and delivery cost.

2.11 Deliveries within the European Union and Tax Rules

2.11.1 Deliveries are made from the territory of the Republic of Poland to selected EU member states. Due to the functioning of the EU Single Market, deliveries are not subject to customs duties.
2.11.2 Product prices in the store include VAT in accordance with applicable tax laws concerning distance sales of goods within the European Union.
2.11.3 Clients who are entrepreneurs from other EU member states, holding a valid EU VAT identification number, may make purchases without VAT, provided they enter a valid EU VAT number during the ordering process and select this option in the shopping cart.
2.11.4 The condition for applying a 0% VAT rate is the confirmation of the EU VAT number validity in the VIES system and compliance with the rules provided for intra-community supply of goods. In the absence of a valid EU VAT number, the sale will be carried out with VAT applied according to the applicable rate.

  1. CUSTOMER ORDER

3.1 Placing an Order
Orders are placed by selecting products available on the britishshop.pl website. Adding a product to the order is done by clicking the "Add to Cart" button.

3.2 Order Registration
After placing an order, the Client receives confirmation of its registration electronically at the e-mail address provided during the ordering process.
The confirmation includes, in particular:

  • order number
  • list of ordered products
  • delivery address
  • order value

Acceptance of the order for fulfilment occurs when its status is changed to "accepted for processing."

In justified cases, order fulfilment may be suspended until verification, in particular in cases of:

  • high-value orders
  • orders including an unusually large number of products
  • suspicion of providing false information by the person placing the order
  • providing incorrect contact details – email address, delivery address, etc.

3.3 Order Modification
Since orders are processed by the IT system in specific time intervals, the Client may be able to modify the order by contacting the Seller electronically at: [email protected]
The Seller will inform the Client whether the order modification is possible.

3.4 Order Cancellation
The Client may request the cancellation of an order by sending an e-mail to: [email protected]
The e-mail must be sent from the same e-mail address used during order placement.

3.5 Right of Withdrawal

3.5.1 Consumers have the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with the Consumer Rights Act.
3.5.2 The withdrawal period expires 14 days from the day the goods are received by the consumer or a person designated by them.
3.5.3 A statement of withdrawal can be sent to: [email protected]
3.5.4 The consumer is obliged to return the goods no later than 14 days from the day of informing the Seller about the withdrawal.
3.5.5 The consumer bears the direct costs of returning the goods unless agreed otherwise.
3.5.6 The consumer is responsible for any diminished value of the goods resulting from using them in a way exceeding what is necessary to establish the nature, characteristics, and functioning of the goods.
3.5.7 The Seller shall refund all payments received from the Consumer, including delivery costs corresponding to the cheapest available form of delivery, no later than 14 days from receiving the withdrawal statement.
3.5.8 The Seller may withhold the refund until receiving the returned goods or confirmation of their shipment.
3.5.9 The right of withdrawal does not apply in cases specified in Article 38 of the Consumer Rights Act, particularly for:

  • perishable products
  • products with a short shelf life
  • products delivered in sealed packaging that cannot be returned for hygienic reasons once opened
  • newspapers and magazines
  • ambient food products (long shelf-life food products) once opened
  • products imported or priced for individual customer orders (e.g., BringForMe products) unavailable in the standard store offer

3.5.10 Before placing an order for BringForMe products, the Client is explicitly informed about the impossibility of return.
3.5.11 Provisions relating to Consumers also apply to so-called entrepreneurs with consumer rights if they meet the statutory criteria of a consumer.

3.6 Order Fulfilment Time
The order fulfilment time (maximum shipping period, counted in days from the day following receipt of payment) depends on product availability and is indicated for each product on the britishshop.pl website.
If fulfilment within the indicated time is not possible, the Seller will contact the Client to arrange further order processing.

3.7 Non-Working Days
The Seller does not process orders on statutory non-working days.
The Seller may also designate additional days when orders will not be processed.

3.8 Refusal to Fulfil an Order
The Seller may refuse to fulfil an order in particular in cases of:

  • suspicion of providing false information or fraudulent activity
  • inability to confirm the order
  • violation of the Terms and Conditions by the Client
  • product unavailability or logistical reasons
  • failure to make the required payment within the specified period
  • impossibility of delivery to the indicated country or location due to legal or tax reasons
  • threat to product or transport safety in the case of products sensitive to external conditions

Note: Britishshop.pl does not sell alcohol above 0.5% or tobacco products. Alcoholic products available in the store contain up to 0.5% alcohol (so-called non-alcoholic alcohols, in accordance with Article 2, paragraph 2 of the Act on Sobriety and Counteracting Alcoholism, Journal of Laws 1982 No. 35, item 230, as amended). Clients ordering for EU delivery are responsible for compliance with the regulations of the destination country.

3.9 Quantity Limitations
The Seller may also introduce quantity restrictions on the purchase of certain products.

3.10 Invoices

3.10.1 VAT invoices can only be issued if the Client provides a NIP (tax identification number) during order placement.
3.10.2 Invoices and corrective invoices are issued electronically and sent to the e-mail address provided during the order process.
3.10.3 Accounting documents are provided in PDF format.
3.10.4 If the Seller is required to issue invoices in the National e-Invoicing System (KSeF), invoices will be issued in accordance with applicable law.

  1. PAYMENTS

4.1 Payment Methods
The Client makes payment for the order using the method selected during the order process on the britishshop.pl online store.
Available payment methods may include, in particular:

  • online payment by credit/debit card (Visa, Mastercard)
  • online bank transfer via the payment operator Autopay S.A. based in Sopot
  • Online payment processing for fast bank transfers is provided by PayPro S.A.
  • BLIK payment system
  • Apple Pay
  • Google Pay
  • traditional bank transfer to the Seller’s bank account (Polish banks only)

The availability of individual payment methods may depend on the type of order, order value, or delivery location.

4.2 Changes to Payment Methods
The Seller reserves the right to temporarily suspend or withdraw certain payment methods available in the store.

4.3 Underpayments and Overpayments
In case of inability to fulfil part of an order, in particular due to product unavailability, the Seller will refund the amount for missing products after order fulfilment (shipment).
The refund will be made within 7 working days from the order shipment, using the same payment method used by the Client, unless impossible.
In such cases, the Seller will contact the Client electronically to agree on the refund method.

The Seller may cancel an order if online payment is not received within 24 hours or traditional transfers are not received within 2 business days.

  1. ORDER SHIPMENT – DELIVERY

5.1 Carrier

5.1.1 Deliveries may be carried out by a courier company selected by the Client or to a Parcel Locker / Pickup Point chosen by the Client:
5.1.1.1 The carrier may deliver the order to the Client or another person present at the address indicated by the Client.

5.2 Client Absence
When placing an order, the Client – in accordance with the provisions of these Terms and Conditions – selects the delivery method. The Seller informs the Client about order readiness by sending status change emails, e.g., "Shipped."
Additionally, the Client receives notifications via e-mail and/or SMS from the courier company or the Parcel Locker/Pickup Point operator about shipment collection and expected delivery time.

Consequently, the Client should ensure the ability to receive the shipment – be present at the indicated location to accept delivery, or, if using a Parcel Locker/Pickup Point, collect the order within the specified time window.

In case of Client absence or failure to collect the order from a Parcel Locker/Pickup Point, the following rules apply:

5.2.1 Delivery by Courier Company:


5.2.2 If the Client is absent at the delivery address, the courier will notify the Client via e-mail and/or SMS about the unsuccessful delivery.
5.2.3 The courier typically attempts delivery a second time, after which the shipment is returned to britishshop.pl. The courier or Parcel Locker/Pickup Point operator charges a return fee equal to the original shipping cost, which the Client is responsible for paying.
5.2.4 britishshop.pl is not responsible for delivery issues caused by the Client.
5.2.5 britishshop.pl will contact the Client and, upon receiving payment for return and re-shipment, will attempt delivery again after resolving obstacles preventing delivery.
5.2.6 The Seller is responsible for the delivery of goods until they are handed over to the Consumer.
5.2.7 Some products available on britishshop.pl, particularly chocolate, sweets, or other temperature-sensitive food items, may change consistency or appearance during transport, especially during high-temperature periods.
5.2.8 Changes such as softening, partial melting, or re-solidification do not affect product quality or safety and are not grounds for complaint, provided the product is fit for consumption and matches the description. By placing an order, the Client accepts that delivery of temperature-sensitive products during high-temperature periods is at their own risk.
The Seller takes due care in packing and securing temperature-sensitive products but is not responsible for changes in consistency or appearance resulting from transport conditions beyond its control.
5.2.9 Shipment of alcoholic products to the EU requires the Client to ensure that local regulations allow the import of alcohol with up to 0.5% content. Shipments of alcoholic beverages above 0.5% are not fulfilled.

  1. COMPLAINTS AND RETURNS

6.1 Seller’s Liability
The Seller is obliged to deliver goods to the Client in accordance with the contract.
The Seller is responsible for non-conformity of the goods with the contract under the provisions of the Consumer Rights Act.
The Seller is liable for non-conformity of the goods with the contract existing at the time of delivery and revealed within two years from that moment, unless the product’s shelf life is longer.

6.2 Reporting Order Non-Conformity
In case of detecting a discrepancy between the delivery and the placed order, the Client should inform the Seller electronically, describing the discrepancy and attaching photos, at: [email protected]

6.3 Damaged or Defective Products
In case of damage to the goods during transport or delivery of a defective or non-conforming product, the Client should contact the Seller electronically.
After agreement with the Seller, the Client may be asked to:

  • send photos of the product and packaging
  • return the product to the Seller’s address

If the Client agrees to send photos, the complaint may be resolved without returning the product, unless further analysis is necessary.

Shelf Life of Food Products
Food products offered in the Britishshop.pl store have a shelf life determined by the manufacturer.
Due to the nature of imported products and warehouse rotation, the shelf life may be shorter than the maximum period offered by the manufacturer, but always allows safe consumption of the product according to its intended use.
Information on particularly short shelf life may be indicated in the product description.
Shelf life does not constitute grounds for a complaint, provided it corresponds to the information in the product description and allows safe consumption.

6.4 How to Submit a Complaint
A complaint can be submitted by:

The submission should include:

  • order number
  • description of the problem
  • photos of the product being complained about (if possible)

6.5 Complaint Processing
The complaint will be processed within 14 days from receipt.
The Client will be informed of the outcome electronically.
Failure to respond within 14 days is considered acceptance of the complaint.

6.6 Refunds
If the complaint is accepted, the Seller will refund the due amount:

  • within 14 days from the day of receiving the statement on price reduction
  • within 14 days from the day of receipt of the goods or confirmation of their return in case of withdrawal from the contract

The refund will be made using the same payment method used by the Client.

6.7 Returns of Shipments
The Seller does not accept shipments returned cash on delivery.

6.8 Responsibility for Product Storage
The Seller is not responsible for the deterioration of product quality after delivery if it occurred due to reasons attributable to the Client, in particular due to failure to follow the storage conditions indicated by the manufacturer.
This applies especially to perishable products or products requiring specific storage conditions.

6.9 Out-of-Court Dispute Resolution

Consumers may use out-of-court methods to resolve complaints and claims.

In particular, they may:

  • submit a request for mediation;
  • submit a request for their case to be considered by the appropriate permanent consumer arbitration court operating under the Polish Trade Inspection.

Further information about out-of-court dispute resolution and the competent authorities is available from the Polish Office of Competition and Consumer Protection (UOKiK) and the relevant Regional Inspectorates of the Trade Inspection.

The European Union Online Dispute Resolution (ODR) platform has been discontinued and is no longer available.

  1. FINAL PROVISIONS

7.1 Obligation to Provide True Information
Clients using Britishshop.pl services are obliged to provide true, current, and complete data necessary to fulfil the order, in particular identification, address, and contact data.
Britishshop.pl is not responsible for non-performance or improper performance of the service resulting from false or incomplete information provided by the Client.

7.2 Delivery of E-mails
Britishshop.pl sends information regarding order processing to the e-mail address provided by the Client during order placement or account registration.
britishshop.pl is not responsible for undelivered e-mails caused, in particular, by:

  • incorrectly provided e-mail address by the Client
  • operation of anti-spam filters or other security measures used by the Client’s e-mail provider
  • technical problems beyond britishshop.pl control

7.3 Refunds
In case of refusal to fulfil the order according to the Terms and Conditions, unavailability of ordered products, or cancellation of an order paid by the Client, Britishshop.pl will refund the due amount immediately, no later than 14 days from the event causing the refund.
Refunds are made using the same payment method used by the Client unless the Client agrees to another method that does not incur additional costs.

7.4 Amendments to the Terms and Conditions

7.4.1 Britishshop.pl reserves the right to amend the Terms and Conditions for future effect for the following important reasons:
a) introduction of new website functionalities or services
b) changes in laws affecting the online store
c) changes in website operation or functionalities to improve safety or convenience
d) introduction of new services or changes in purchasing rules

7.4.2 Any changes will be communicated by posting relevant information on the store’s website.
7.4.3 The amendment takes effect on the date indicated in the information about the change, not shorter than 14 days from publication.
7.4.4 Orders placed before the new Terms come into effect are governed by the Terms applicable at the time of order placement.
7.4.5 Registered Clients with an account may withdraw from using the store’s services within 14 days of being informed of the change.

7.5 Disputes
Disputes between the Seller and the Client will be resolved by the competent common court in accordance with the provisions of the Polish Code of Civil Procedure of 17 November 1964.

7.6 Customer Satisfaction Survey
After delivering the goods, Britishshop.pl may request the Client to evaluate the transaction by sending an invitation to complete a survey to the e-mail provided during order placement. Completion of the survey is entirely voluntary.

7.7 Language Versions of the Terms and Conditions
In case of discrepancies between different language versions of the Terms and Conditions, the Polish version shall prevail.

  1. RECORDING, SECURITY, AND ACCESS TO CONTRACT TEXT

8.1 Recording, securing, and providing order data is done via e-mail and by making it available in the Client’s account on the online store.
8.2 Recording, securing, and providing the Terms and Conditions is done by publishing them on the Britishshop.pl website in the "Terms and Conditions" section.
8.3 Registered Clients have access to their order history after logging into their account and navigating to the "My Orders" section.

  1. PERSONAL DATA PROTECTION

9.1 The data controller is Fish And Chips Spółka z ograniczoną odpowiedzialnością, based in Warsaw, ul. Stefana Batorego 18/108, 02-591 Warsaw, entered in the Register of Entrepreneurs of the National Court Register.
