Terms of britishshop.pl site effective from 01.01.2023

  1. DEFINITIONS

Seller - Fish and Chips Spółka z o.o. - the owner of the britishshop.pl website, with its registered office at ul. Stefana Batorego 18/108, 02-591 in Warsaw, registered in the District Court for the m.st. Warsaw, XIII Commercial Division of the National Court Register, under KRS number 0000330033, NIP: 5252455317, REGON: 141883310, BDO number: 000556105, share capital: PLN 5000.00.  britishshop.pl - an online store run by the Seller, i.e. by Fish and Chips Spółka z o.o., where you can make purchases through the website britishshop.pl

Regulations - these regulations defining the terms and conditions of making purchases in britishshop.pl

Terms of Service - "Terms of www.britishshop.pl website, which set out the rules for the use of the britishshop.pl website and the services made available through the britishshop.pl website,

Account - marked with an individual name (login) and password, a set of resources in the ICT system of the britishshop.pl website administrator, in which the data of the User who has registered on the britishshop.pl website in accordance with the Website Regulations are collected

Customer - any customer purchasing a product in the britishshop.pl store

Consumer - a natural person who purchases goods from the Seller for purposes not directly related to his business or professional activity

Entrepreneur with Consumer rights - a natural person who purchases goods from the Seller under a sales contract directly related to its business activity, when the content of this contract shows that it does not have a professional character for it, resulting in particular from the subject of its business activity, made available on the basis of the provisions on the Central Registration and Information on Economic Activity.

  1. SHOPPING IN BRITISHSHOP.PL

2.1. Activities

britishshop.pl sells goods via the Internet. Orders can only be placed via britishshop.pl websites.

2.2. Area of action

Services offered by Britishshop.pl are available on the territory of the Republic of Poland and selected European Union countries. The feasibility of the order is determined on the basis of the declared place of delivery and the availability of products imported from Great Britain.

2.3. Buyer

The offer britishshop.pl may be used only by adult natural persons with full legal capacity, determined according to the provisions of civil law, legal persons and other organizational units with legal capacity.
In order to use the offer presented on the britishshop.pl website, you can register a Customer account on the britishshop.pl website in accordance with the "Website Regulations".  Registration on the britishshop.pl website and the use of the Account access service are free of charge. By registering between the Customer and the Seller, an agreement is concluded for the provision of electronic services consisting in maintaining an Account, on the terms set out in the "Website Regulations". The account is maintained for an indefinite period. The Customer may delete the Account at any time by sending such information to Fish and Chips Spółka z o.o. (e-mail: info@britishshop.pl.   Deletion of the account means termination of the contract for the provision of electronic services regarding the maintenance of the Account. In the event of deletion of the account, all data will be deleted, except for the data necessary for the complaint process and handling possible claims, which will be stored until the expiry of the limitation periods for claims resulting from completed orders. The Customer's Account will be automatically deleted after a period of 3 years from the date of the last activity on the Account.

2.4. Product information

2.4.1 Information on the products offered for sale britishshop.pl posted on the website, such as: description, composition, calorific value, weight of packaging, expiration dates, etc. They come from the manufacturers of the products and can be changed by the manufacturer. Britishshop.pl makes every effort to ensure that they are correct and up-to-date, but before using the products, the Customer is obliged to read the information provided by the manufacturer on the product packaging. Photos of products and product packaging placed on the britishshop.pl website reflect the image of the product at the time of adding it to the britishshop.pl website, but often the manufacturer changes the appearance of the packaging, marketing description of the product – so it may happen that the photo or description does not show the currently available product.  

2.4.2 Britishshop.pl informs on the Website about the expiry / expiry dates of only selected products currently available in the britishshop.pl – products with a short expiry date/"best before" date.   

2.5. PERSONAL COLLECTION OF ORDERS

2.5.1 The Seller does not offer possibility of collecting orders placed online. 

2.6. Prices of goods

2.6.1 The prices of goods and delivery costs shown on the website are britishshop.pl gross prices [including VAT], expressed in Polish zlotys.

2.7. Discounts, promotions, vouchers

2.7.1 The discount on the voucher issued by britishshop.pl cannot be combined with discount programs and other promotions.

2.7.2 Special discounts cannot be combined with discount programs and other promotions.

2.7.3 Due to the mathematical differences resulting from the conversion of discounts in relation to net and gross prices, the value of the rebate may differ from the granted value of the discount by a maximum of 0.3% (three tenths of a percent).

2.7.4 britishshop.pl provides for the possibility of introducing programs providing additional benefits for Customers. The rules for participation in such programs will be determined each time by separate regulations.

2.7.5 Customers who have given their consent may britishshop.pl offer promotions

2.8. Order

The order is understood as the Customer's acceptance of the britishshop.pl offer using the mechanisms of the britishshop.pl store, preceded by the acceptance of the selection of goods and the choice of payment method and form of delivery, in accordance with point 3.1.

2.9. Sales contract and applicable price

Sales contracts are concluded as part of an organized system of concluding distance contracts using the mechanisms of the britishshop.pl store. Britishshop.pl sends the Customer an order confirmation, order number to the e-mail address provided by the Customer.

2.10. Delivery, delivery costs, packaging costs

2.10.1 The cost of delivery, including packaging, is determined each time in the ordering process.

Depending on the declared place, the number of products in the order, the type of products in the order, the delivery may be made via a courier company selected by the Customer when placing the order, acting on behalf of the britishshop.pl, or via delivery to a post office box (Parcel Locker)

If you choose a post office box, the delivery address is the address of the Parcel Locker selected by the Customer when placing the order.

2.10.2 All information about available forms and delivery costs will be visible in the shopping cart of the website britishshop.pl after adding the products.

2.10.4 Quantitative restriction

Britishshop.pl reserves the right to introduce a quantitative limit on the purchase of certain goods or to make them dependent on the value of the Customer's order.

2.10.5 All orders where shipping is required would have a delivery cost calculated online. Where no delivery cost is indicated, our system was unable ti calculate it due to size/volume/desination and such delivery cost will be calculated manually. 

  1. CUSTOMER'S ORDER

3.1. Placing and accepting an order

The order is placed by selecting from the offer on the britishshop.pl website, products offered for sale. Adding products to the virtual shopping cart takes place after clicking the "Add to cart" button.

3.2. Order registration

Registration of the Customer's order will be confirmed electronically, i.e. by e-mail sent to the address indicated by the Customer during the registration of the Account with the status - New. The order confirmation will contain, m.in: order number, ordered products, delivery address, order value.

Acceptance of the order for execution takes place after changing the status to "in progress".

The commencement of the order may be suspended for verification in justified cases (e.g. in the case of a significant value of the order or when the order covers a large number of a given product, significantly different from the number that are usually the subject of orders, if there is a suspicion of providing false data by the person placing the order)

3.3. Possibility to change the order

Due to the fact that all orders placed by Customers are processed at certain times by the IT system of Britishshop.pl and that the lead time in some cases may be as indicated for the product on the britshshop.pl website, the Customer may potentially be able to make changes to his order by sending an e-mail asking about the possibility of change, giving details, to the address of info@britishshop.pl. The seller will respond back about the possible possibility of making changes to the order and how to do it.

3.4. Possibility to cancel an order

Due to the fact that all orders placed by customers are processed at certain times by the bitishshop.pl IT system, the Customer may also be able to cancel the order. The declaration of willingness to cancel the order can be submitted by e-mail to the address info@britishshop.pl, forwarding the e-mail received after placing the order from the email account that was used in the ordering process, entering in this message a request to cancel the order.

3.5. Right of withdrawal

3.5.1 The consumer acknowledges that in accordance with the provision of art. 27 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, późn.zm.), he has the right to withdraw from the Distance Agreement without giving reasons by submitting a statement to the Seller within 14 days from the date of release of the Goods.

The declaration of withdrawal from the contract can be submitted via e-mail to the address info@britishshop.pl.

3.5.2 The right to withdraw from a distance contract is not entitled to the Consumer in the following cases:

goods subject to rapid deterioration (e.g. fresh vegetables, fruit, meat, cold cuts, frozen food in the event of interruption of the cold chain) or having a short shelf life, including goods that due to their nature (e.g. frozen products) cannot be returned,

goods delivered in a sealed package, which after opening the package can not be returned due to healthprotection or hygiene reasons, if the packaging wasopened after delivery,

delivered press (newspapers, periodicals, magazines).

3.5.3 In the event of withdrawal from the contract, the Consumer is obliged to notify the Seller by e-mail to the address of the info@britishshop.pl of the desire to return the returned goods in an unaltered state, in particular he should not use the goods in a way that goes beyond what is necessary to establish the nature, characteristics and functionality of the goods. Otherwise, the Consumer will be liable for reducing the value of the Goods. The return of goods should take place immediately to the Seller's address provided in the Contact tab, but not later than within 14 days from the date of receipt by the Seller of the notification of withdrawal from the contract. To meet this deadline, it is sufficient to send back the Goods before its expiry after informing the Seller by e-mail to the info@britishshop.pl address about the intention to return.

3.5.4. The consumer bears only the direct costs of returning the goods, which should be understood in particular as the cost of returning the goods to the Seller to the address provided in the Contact tab. Returned goods must be properly packed and secured so that they are not damaged on the way back to the Seller.

3.5.5. The Seller shall immediately, but not later than within 14 days of receiving from the Consumer a statement of total or partial withdrawal from the contract, return to the Consumer the payment made by him for the returned goods, and the costs of delivery of the returned goods corresponding to the costs of the cheapest usual delivery method offered by the Seller.

3.5.6. The Seller may withhold the refund of the payments referred to in the preceding point until the Consumer returns the goods to which the withdrawal from the contract relates, or the Consumer provides confirmation that he has sent them back, depending on which of these events (return or delivery of confirmation) occurs earlier.

3.5.7. The refund of the payment will be made using the method of payment used by the Consumer.

3.5.8. The right to withdraw from the contract does not exclude the Consumer's rights arising from the Seller's liability for non-conformity of the goods with the contract.

3.5.9. The Customer is not entitled to withdraw from the contract if he has concluded the contract as part of his business activity (as an entrepreneur).

3.5.9a. The provisions concerning the Consumer contained in subsection 3.5. shall apply to the Entrepreneur with the rights of a Consumer.

3.5.10 Within 14 days after the Seller receives the Customer's statement of withdrawal from the contract, the Customer will receive a refund of the amount paid, including the costs of delivery of the item corresponding to the costs of the cheapest usual delivery method offered by the Seller.

3.6. Term of the contract

3.6.1 The delivery time (maximum order shipping period) of an order depends on the availability of imported products and is shown next to each product on the britishshop.pl website.

3.6.2 In a situation where the execution (shipment) of the order will not be possible within the given maximum deadline, the Seller will contact the Buyer via e-mail and agree on further steps in the implementation of his order.

3.7. Public holidays

3.7.1 The Seller does not process orders on public holidays.

3.7.2 The Seller reserves the right to set additional closing days for the store. You will not be able to place orders on these days.

3.8. Place and date of delivery of the order

3.8.1 Depending on the Customer's preferences and the declared place of delivery, the order will be sent to the address indicated by the Customer:

through the courier company – within the maximum time specified on the website britishshop.pl for each product available for order from the moment the payment for the order is posted.

3.8.2 In the event of a delay or failure to ship the order within the stated maximum period, the Seller will contact the Customer to determine further steps.

3.9. Refusal to process the order

3.9.1 Britishshop.pl reserves the right to refuse to process an order in certain cases, including the examples below:

3.9.1.1 There are clear doubts about the person of the Customer (this applies in particular to cases where there is a suspicion that the orders in question are placed by the same person using different accounts, e.g. in order to circumvent specific quantitative restrictions on the Goods offered as part of promotional campaigns).

3.9.1.2 The order could not be confirmed and it was deemed by the Britishshop.pl to require confirmation in accordance with paragraph 3.2 above.

3.9.1.3 The Customer does not comply with the rules of the Regulations.

3.9.1.4 The order cannot be executed for logistical reasons (e.g. when, due to the nature of the Goods, they are not available within the time period expected by the Customer – which is different from the maximum delivery time indicated for each product.

3.9.2.1 The Seller reserves the right to limit sales to the Customer. This condition applies to products in a promotion or other indication of the promotional price of the product offered. The customer is informed about possible limits after placing the order.

3.9.2.2 The Seller reserves the right to limit sales to the Customer due to the current stock of products on offer. The Customer is informed about possible limits after placing the order.

3.10. Invoice

3.10.1 The Seller informs that in accordance with the provisions of the Act on tax on goods and services in force from January 1, 2020. The Seller may issue an invoice to a VAT or value added tax payer only if the Customer provides his NIP number (EU VAT) when placing the order, otherwise the Seller will not be able to later issue an invoice with the Customer's NIP number (EU VAT).

3.10.2 By placing an order, the Customer each time accepts that the VAT invoice and correcting invoice for a given order are issued in electronic form and sent to the customer to the e-mail address used when placing the order within 7 days from the date of completion (shipment) of the order. The pro forma invoice is sent automatically with an e-mail confirming the order, if the customer has provided the data for issuing the invoice and his NIP number (EU VAT).

3.10.3 A VAT invoice or a correcting invoice will be made available in PDF format. This means that in order to be able to read the file containing a VAT invoice or a correcting invoice, the Customer should have the appropriate software installed.

3.10.4 The Customer authorizes Fish and Chips Spółka z o.o. to issue VAT invoices without the recipient's signature.  

3.10.5 In the case of a Customer who is a consumer, Fish and Chips Spółka z o.o. will issue and provide the Customer with a VAT invoice in the form and manner indicated in point 3.10.3 et seq. of these Regulations, while the issued fiscal receipt will remain in the possession of Fish and Chips Spółka z o.o. , if the Customer provides his NIP number (EU VAT) when placing the order, otherwise, the Seller will not be able to later issue an invoice with the Customer's NIP number (EU VAT).

  1. PAYMENTS

4.1. Payment methods

The customer makes payments for purchases made in britishshop.pl in the manner specified on the website britishshop.pl in the order acceptance process. The following payment methods are possible:

4.1.1 for purchases made via courier and delivery to Parcel Lockers;

online card payment

payment by online bank transfer

payment by traditional bank transfer

4.1.2 The Seller reserves the right to withhold or delete certain forms of payment.

4.2. Settlement of underpayments and overpayments

4.2.2.1 In the event of unavailability of products for the order, the Seller will refund for the missing products within 7 working days from the date of completion (shipment) of the order, in the same way as the Customer paid for the order.  If the return is not possible in the same way, the Seller will contact the Buyer via e-mail and agree on the method of return.

  1. SHIPMENT OF THE ORDER - DELIVERIES

5.1. Supplier

5.1.1 Deliveries may be made by a courier company selected by the Customer or to a post office box (Parcel Locker) selected by the Customer:

5.1.1.1 The Supplier may issue an order to the Customer or another person present at the address indicated by the Customer.

5.2. Absence of the Customer

When placing an order, the Customer - in accordance with the provisions of these Regulations - chooses the form of delivery. The Seller informs the Customer about the availability of the order for shipment by sending an email about the change in the status of the order – for example, "Ready for Shipment", "Shipped". In addition, the Customer receives notifications via e-mail and/or SMS from the courier company and the Parcel Locker service about the receipt of the shipment and the expected delivery date. As a consequence, the Customer should be present at the place indicated by him and to accept the delivery, and in the event of choosing delivery via a post office box (Parcel Locker), the Customer should pick up the order in the time window provided by the PO box (Parcel Locker). If the Customer is absent or the Customer does not collect the order from a post office box (Parcel Locker), the following rules will apply.

5.2.1 Delivery by courier:

5.2.2 In the absence of the Customer at the delivery address indicated by him, the courier company will notify the Customer via e-mail and/or SMS about the lack of delivery possible.

5.2.3 The courier will make additional attempts to deliver the parcel, after which it will be sent back to britishshop.pl. The courier company and the operator of Parcel Lockers charge a fee for returning an undeliverable or uncollected parcel to britishshop.pl in the same amount that the Customer paid for shipping, so the Customer will be responsible for paying this amount.

5.2.4 Britishshop.pl shall not be liable for difficulties in the delivery of the parcel attributable to the Customer.

5.2.5 Britishshop.pl will contact the Customer and, after receiving the return fee and re-dispatch, will attempt to send the shipment again after eliminating the obstacles preventing the delivery of the order.

5.2.6 Except in cases of non-performance or improper performance of the contract by the Seller, the responsibility for the actions of the courier company employee in the delivery of the order by him to the Customer shall be borne by the courier company or, in the case of Parcel Lockers, the company operating PO boxes.

  1. COMPLAINTS AND RETURNS

6.1.1 It is the Seller's responsibility to deliver the ordered goods in accordance with the contract to the Customer.

6.1.2 The goods are in conformity with the contract if in particular their:

- description, type, quantity, quality, completeness and functionality and, for goods with digital elements, also compatibility, interoperability and availability of updates;

- suitability for a specific purpose for which it is needed by the Consumer or Entrepreneur with the rights of a Consumer, about which the Consumer or Entrepreneur with the rights of a Consumer, notified the Seller at the latest at the time of conclusion of the contract and which the Seller accepted.

6.1.3 In addition, in order to be considered in conformity with the contract, the goods must:

- be fit for the purposes for which goods of this type are usually used, taking into account applicable laws, technical standards or good practice;

- be present in such quantity and have such characteristics, including durability and safety, and in relation to goods with digital elements - also functionality and compatibility, which are typical for goods of this type and which the Consumer or Entrepreneur with the rights of a Consumer can reasonably expect, taking into account the nature of the goods and public assurance given by the Seller, his legal predecessors or persons acting on their behalf, in particular in advertising or on a label, unless the Seller demonstrates that:

(a) was unaware of the public assurance and, judging reasonably, could not have been aware of it;

(b) prior to the conclusion of the contract, the public assurance has been rectified in accordance with the conditions and form under which the public assurance was given, or in a comparable manner;

  1. c) public assurance did not affect the Consumer's decision or the Consumer's rights to conclude a contract.

- be supplied with packaging, accessories and instructions, the delivery of which the Consumer or Entrepreneur with the rights of a Consumer can reasonably expect;

- be of the same quality as the sample or pattern that the Seller made available to the Consumer or Entrepreneur with the rights of the Consumer before the conclusion of the contract, and correspond to the description of such sample or such pattern.

6.1.4 The Seller shall not be liable for the lack of conformity of the goods with the contract to the extent referred to in point 6.1.3, if the Consumer or the Entrepreneur with the rights of the Consumer, at the latest at the time of conclusion of the contract, has been clearly informed that the specific characteristic of the goods deviates from the requirements of conformity with the contract set out in point 6.1.3, and has expressly and separately accepted the lack of a specific characteristic of the goods.

6.1.5 The Seller shall be liable for any lack of conformity of the goods existing at the time of delivery and revealed within two years of that time, unless the expiry date of the goods is longer as determined by the Seller, its legal predecessors or persons acting on their behalf. A lack of conformity of goods which becomes apparent within two years of delivery shall be presumed to have existed at the time of delivery, unless it is proved otherwise or that this presumption is irreconcilable with the nature of the goods or the nature of the lack of conformity of the goods.

6.1.6 The Seller may not rely on the expiry of the deadline for establishing the lack of conformity of the goods with the contract specified in paragraph 6.1.5, if this deficiency has been fraudulently concealed.

6.1.7 If the goods are not in conformity with the contract, the Consumer or Entrepreneur with the rights of a Consumer may request its repair or replacement.

6.1.8 The Seller may make an exchange when the Consumer or Entrepreneur with the rights of a Consumer requests repair, or the Seller may make a repair when the Consumer or Entrepreneur with the rights of a Consumer requests replacement, if bringing the goods into conformity with the contract in the manner chosen by the Consumer or Entrepreneur with the rights of Consumer is impossible or would require excessive costs for the Seller. If repair and replacement are impossible or would require excessive costs for the Seller, he may refuse to bring the goods into conformity.

6.1.9 When assessing the excessive costs for the Seller, all the circumstances of the case are taken into account, in particular the significance of the lack of conformity of the goods with the contract, the value of the goods in conformity with the contract and excessive inconvenience for the Consumer or the Entrepreneur with the rights of the Consumer resulting from the change in the manner of bringing the goods into conformity with the contract.

6.1.10 The Seller shall repair or replace it within a reasonable time from the moment the Seller was informed by the Consumer or Entrepreneur with the rights of a Consumer about the lack of conformity with the contract, and without undue inconvenience to the Consumer or the Entrepreneur with the rights of a Consumer, taking into account the specificity of the goods and the purpose for which the Consumer or Entrepreneur with the rights of a Consumer purchased it. The costs of repair or replacement, including in particular the costs of postage, transport, labor and materials, shall be borne by the Seller.

6.1.11 The Consumer or the Entrepreneur with the rights of a Consumer makes available to the Seller the goods subject to repair or replacement. The Seller collects the Goods from the Consumer or Entrepreneur with the rights of the Consumer at his own expense.

6.1.12 The Consumer or Entrepreneur with the rights of a Consumer is not obliged to pay for the normal use of the goods, which were subsequently replaced.

6.1.13 If the goods are not in conformity with the contract, the Consumer or the Entrepreneur with the rights of a Consumer may submit a statement on price reduction or withdrawal from the contract when:

- The Seller has refused to bring the goods into conformity with the contract in accordance with point 6.1.8 above;

- the Seller has not brought the goods into conformity with the contract in accordance with paragraphs 6.1.10 to 6.1.11 above;

- the lack of conformity of the goods with the contract persists, despite the fact that the Seller tried to bring the goods into conformity with the contract;

- the lack of conformity of the goods with the contract is so significant that it justifies a price reduction or withdrawal from the contract without prior recourse to the protection measures specified in points 6.1.7 to 6.1.12 above;

- from the Seller's statement or circumstances it is clear that he will not bring the goods into conformity with the contract within a reasonable time or without undue inconvenience to the Consumer or the Entrepreneur with the rights of the Consumer.

 6.1.14 The Consumer or the Entrepreneur with the rights of a Consumer may not withdraw from the contract if the lack of conformity of the goods with the contract is irrelevant. The lack of conformity of the goods with the contract shall be presumed to be material.

 6.1.15 If the lack of conformity with the contract concerns only some of the goods delivered under the contract, the Consumer or the Entrepreneur with the rights of a Consumer may withdraw from the contract only in respect of these goods, as well as in relation to other goods purchased by the Consumer or the Entrepreneur with the rights of the Consumer together with goods not in conformity with the contract, if it cannot reasonably be expected, so that the Consumer or Entrepreneur with the rights of a Consumer agrees to keep only goods in accordance with the contract.

6.2. In the event of non-compliance of the delivery with the placed order, the Customer should notify the Seller by e-mail to the address info@britishshop.pl and agree on further actions.

6.3. In the event of damage to the goods during transport or delivery of an article with a manufacturing defect or not in accordance with the contract, the Customer is obliged to contact via e-mail to the address info@britishshop.pl and agree on further steps, where an example may be, after prior arrangement, sending back the received goods to the address  of the Seller indicated in point 1 of the Regulations and the possibility of demanding a refund for it and the return of  documented and documented and adequate shipping costs. Alternatively, the britishshop.pl may offer the Customer to send photos of the product, including pictures of the labels. If the Customer agrees to such a method of considering the complaint, the complaint is considered without the need to send the goods back by the Customer, unless after analyzing the photos there is a need for a detailed analysis of damage or non-compliance of the goods with the contract.

6.4 A complaint may be submitted:

6.4.1 by e-mail to the address info@britishshop.pl,

The content of the application sent electronically should include the order number, photos of the product complained about and the exact reason for the complaint

6.5. The submitted complaint will be considered within 14 days from the date of its receipt by the Seller, by e-mail to the address info@britishshop.pl. Written information about the result will be sent to the Customer's email address. Lack of response within the indicated period will be considered as a positive consideration of the complaint.

6.6. The Seller returns to the Customer the amounts due:

- as a result of exercising the right to reduce the price, immediately, not later than within 14 days from the date of receipt of the statement on the price reduction

- as a result of exercising the right of withdrawal, immediately, no later than within 14 days from the date of receipt of the goods or proof of their return.

The Seller shall refund the price using the same method of payment as used by the Consumer or Entrepreneur with the rights of a Consumer, unless the Consumer or Entrepreneur with the rights of a Consumer has expressly agreed to a different method of refund, which does not involve any costs for him.

6.7. Britishshop.pl does not accept any COD returns.

6.8. Britishshop.pl is not responsible for the quality of products if this quality has deteriorated after the products were delivered to the Customer and for reasons attributable to the Customer (perishable products, fresh products, products with short expiry dates, etc. – e.g. in a situation where the Customer did not store the products in appropriate conditions indicated by the manufacturer)

6.9. Britishshop.pl as a seller informs the customer about the possibility of using out-of-court methods of dealing with complaints about the Goods, m.in. by submitting by the Customer after the complaint procedure a request for mediation or a request for consideration of the case before an arbitration court. The list of permanent Consumer Arbitration Courts operating at the Provincial Inspectorates of Trade Inspection is available here. Out-of-court redress after the complaint procedure is free of charge. In the case of a Customer who is a consumer who wants to use the out-of-court method of redress, it is additionally possible to submit a complaint via the EU ODR online platform, available at this address.

  1. FINAL PROVISIONS

7.1. Obligation to provide truthful information

The customer using the services of Britishshop.pl is forbidden to provide false data. Britishshop.pl is not responsible for non-performance of the service in such a case.

7.2. Delivery of e-mails

Britishshop.pl is not responsible for failure to deliver a message sent to the e-mail address indicated by the Customer, which may be caused by blocking or deleting e-mails by software installed on the computer used by the Customer or blocking by mail server administrators or other failure.

7.3. Refunds

In the event of refusal to process the order in accordance with the provisions of the Regulations or in the event of unavailability of products ordered and paid for by the Customer, or in the event of cancellation by the Customer of a previously paid order, the Britishshop.pl will make on the basis of the Customer's request sent to the following address: info@britishshop.pl full refund of the amount paid in accordance with the provisions of point 3.5.7. of these Regulations. In the absence of a request from the Customer, the Customer authorizes the Britishshop.pl to deduct the resulting overpayment (related to the cancelled or incomplete order) from the value of the next order.

7.4. Amendments to the Terms and Conditions

7.4.1 Britishshop.pl reserves the right to amend the Terms and Conditions with effect for the future for the following important reasons:

  1. a) a new functionality of the website or application will be introduced, the use of which cannot take place on the basis of the existing Regulations,
  2. b) the change is forced by law,
  3. c) the existing functionality of the Website or Application will be changed, in particular to increase the comfort or facilitate the use of the Website or Application,
  4. d) new services or rules for making purchases or changes in the scope of services provided or rules of making purchases will be introduced, the use of which cannot take place on the basis of the existing Regulations.

 

7.4.2. The website will britishshop.pl inform about each change to the Regulations by displaying information on the main page of the website for a period of 30 days.

 

7.4.3. The amendment to the Regulations shall enter into force on January 1, 2023

 

7.4.4. For orders placed and not executed before the date of entry into force of the new Regulations, the provisions of the Regulations in force at the time of placing the order shall apply.

 

7.4.5. In the event of any amendment to the Regulations, registered customers have the right to resign from the services provided within 14 days from the date of notifying them about the amendment to the Regulations.

7.5. Disputes

Disputes are heard by a competent common court determined in accordance with the provisions of the Act of 17 November 1964. Code of Civil Procedure (Journal of Laws of 1964, No. 43, item 296, as amended).

7.6. Customer satisfaction survey

After delivering the Goods to the Customer, the Britishshop.pl reserves the right to examine the Customer's opinion about the transaction by sending the Customer to the e-mail address indicated in the order an invitation to complete the survey (the Customer is not obliged to complete it) and by phone.

  1. RECORDING, SECURING AND MAKING AVAILABLE THE TEXT OF THE AGREEMENT

8.1. The order data is recorded, secured and made available via e-mail.

8.2. The consolidation, securing and making available of general terms and conditions (terms of sale) takes place through the website Britishshop.pl in a dedicated section of the Website Regulations.

8.3. The registered Customer can see previous orders after logging in to the Britishshop.pl store and going to the "My orders" tab.
